Terms & Conditions and Refund Policy

These Terms govern your use of the Remote Online Notarization (“RON”) services offered by BKS Notary Services (“we,” “us,” “the Notary”) at notary.bks.agency. By booking an appointment, creating an account, or submitting payment, you agree to these Terms.

1. Services

We provide Remote Online Notarization in accordance with New Jersey law (N.J.S.A. 52:7 and the Revised Uniform Law on Notarial Acts, P.L. 2021, c. 179). Notarization is performed over a live audio-video session. Identity is verified through credential analysis and knowledge-based authentication (KBA) or the notary’s personal knowledge, as permitted by law.

2. Eligibility & Your Responsibilities

You must present a valid, unexpired government-issued photo ID, and the name on your ID must match your account and documents.
You must have a device with a working camera and microphone and a stable internet connection.
You are responsible for the accuracy and completeness of all information and documents you provide.
Certain documents cannot be notarized remotely under New Jersey law (for example, wills and codicils). If your document is ineligible, the session cannot proceed.

3. Fees & Payment

Fees are presented at checkout before payment and are charged in U.S. dollars via our payment processor, Stripe. Fees may include the notarial act fee(s), platform access fees, and identity-verification (KBA/credential-analysis) fees. Applicable taxes, if any, are shown at checkout.

4. Refund Policy, Non-Refundable Items

The following are non-refundable once initiated or completed:

Platform access fees, non-refundable once your session has been scheduled and access is provisioned.
Identity-verification fees (KBA / credential analysis), non-refundable once the verification process has been initiated, whether or not it succeeds, because third-party verification costs are incurred at that point.
Completed notarization session fees, non-refundable once the notarial act has been performed.

If a notarization cannot be completed for reasons within our control (for example, a technical failure on our side), we will work with you to reschedule at no additional charge or, at our discretion, issue a refund of the notarial act fee only. Failure of identity verification, an ineligible or improperly prepared document, or your inability to complete the session does not entitle you to a refund of the fees described above.

5. Cancellation, Rescheduling & Missed Appointments

Rescheduling: You may reschedule at no charge with at least 2 hours’ notice before your appointment, subject to availability.
Late cancellation / no-show: If you cancel with less than 2 hours’ notice, do not appear for your scheduled session, or are more than 10 minutes late, the appointment is treated as a missed appointment and fees are non-refundable. A new booking and payment are required to reschedule.
We may cancel or reschedule an appointment if identity cannot be verified, if the connection is inadequate, or if we suspect fraud or unlawful activity.

6. Recording & Records Retention

Every RON session is recorded (audio and video) as required by law, and the recording and electronic journal entry are retained for a minimum of 10 years. By proceeding, you consent to this recording.

7. Prohibited Use & Fraud

You may not use our services to commit fraud, misrepresent your identity, or notarize documents you are not authorized to sign. We will refuse or halt any notarization we believe to be unlawful, coerced, or fraudulent, and we cooperate with law enforcement as required.

8. Disclaimers & Limitation of Liability

We provide notarial services only and do not provide legal advice. A notarization verifies the identity of the signer and the act of signing; it does not attest to the truth, legality, or effect of the document’s contents. To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amount of the fees you paid for the specific notarization at issue.

9. Privacy

Information you provide (including ID details and session recordings) is used solely to perform and document your notarization and to meet our legal retention obligations. We do not sell your personal information.

10. Changes & Contact

We may update these Terms from time to time; the version in effect at the time of your transaction applies. Questions? Contact notary@bks.agency.
